Statement from Fethiye Municipality on Coastal Band Walking Path

Fethiye Municipality made a written statement to inform the public about the ongoing construction works on the Fethiye Coastal Band walking path, one of the district's most heavily used social areas.

In the statement from the municipality, it was reported that the construction work started to make the walking path safer, more comfortable, and longer-lasting was tendered on March 30, 2026, via Open Tender Procedure under the Public Procurement Law No. 4734.

After completing the tender process, a contract was signed with the contractor on April 29, 2026, and on May 4, 2026, the site was handed over and the works began.

"Non-compliant practices with the technical specification were detected"

The statement expressed that after the works started, inspections carried out by the municipality’s technical teams revealed that the contractor did not conduct the work in accordance with the contract and technical specification provisions.
The statement included the following:

“ABOUT THE COASTAL BAND WALKING PATH

The construction work for making the walking path on the Fethiye coastal band safer, more comfortable, and longer-lasting was tendered on 30.03.2026 through an Open Tender Procedure within the scope of Public Procurement Law No. 4734. After the tender process was completed, a contract was signed with the contractor on 29.04.2026, and on 04.05.2026, the site was handed over and works began.
Following the start of the works, inspections by our technical teams determined that the contractor did not progress the work in compliance with the contract and technical specifications. Subsequently, necessary warnings were issued to the firm; deficiencies were requested to be rectified, the work schedule to be followed, and the works to be continued in accordance with the technical specifications, all communicated in writing.

However, despite all warnings, the contractor failed to fulfill its contractual obligations within the specified time.

ACCORDING TO THE PUBLIC PROCUREMENT LAW, IT IS NOT POSSIBLE FOR OUR MUNICIPALITY TO DIRECTLY INTERVENE IN OR ASSIGN THE WORK TO ANOTHER FIRM WHILE THE CONTRACT IS STILL IN EFFECT FOR A SITE THAT HAS BEEN HANDED OVER.

Therefore, the process is being conducted meticulously from technical and legal perspectives within the framework of the Public Procurement Law No. 4734, Public Procurement Contracts Law No. 4735, and related regulations. Necessary legal actions are being implemented with consideration for the public interest.

Our priority is to ensure the walking path is completed in the quality standards stipulated in the contract while protecting public resources and citizens' rights. The process will proceed with all necessary procedures completed within the current legislation; developments will continue to be shared transparently with the public.
